By accessing and using the Exotic Reptile Care mobile application ("the App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
The App is owned and operated by Imad El Khafi through Khafi Studio LLC ("we," "us," or "our"). These Terms constitute a legally binding agreement between you ("User" or "you") and Khafi Studio LLC, and apply to both the iOS and Android versions of the App.

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App.
The App stores your data locally on your device. You are responsible for:
You are responsible for the accuracy and completeness of any information you enter into the App. We are not liable for any consequences resulting from inaccurate or incomplete data.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
The App offers a Pro Pack (one-time purchase) and a Premium subscription that provide access to enhanced features, including:
Pricing and available plans are displayed in the App and may vary by region and promotional periods.
All purchases and subscriptions are processed by the app store you downloaded the App from — the Apple App Store on iOS or Google Play on Android. By making a purchase, you agree to the applicable store's terms of service and payment terms. Charges will be billed to your Apple ID or Google account, as applicable.
Subscriptions automatically renew unless auto-renewal is turned off before the end of the current period, in accordance with the rules of the app store you purchased from. Your account will be charged for renewal within the window defined by that store prior to the end of the current period.
You can manage and cancel your subscriptions through your account settings in the Apple App Store or Google Play. Cancellations take effect at the end of the current billing period. No refunds will be provided for unused portions of a subscription period, except where required by law.
We may offer free trial periods for Premium subscriptions. If you do not cancel before the trial period ends, you will be automatically charged for the subscription. Trial offers are limited to one per user and may not be combined with other promotional offers.
We reserve the right to change subscription prices. Price changes will not affect existing subscribers until their next renewal period, and you will be notified in advance in accordance with the applicable app store's policies.
Because all transactions are handled by the Apple App Store or Google Play, refund requests must be submitted through the store you purchased from, subject to that store's refund policy. We do not have the ability to process refunds directly.
The App and all its content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, and software) are owned by Khafi Studio LLC and are protected by copyright, trademark, and other intellectual property laws.
You retain all rights to the content you create within the App (photos, notes, data). Since your data is stored locally on your device, we do not claim any ownership of your content. If you choose to use the AI species identification feature, the image you submit is transmitted to a third-party AI provider solely to generate a result, as described in our Privacy Policy.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
IMPORTANT: The App is provided for informational purposes only and should not replace professional veterinary advice.
The App provides general information about reptile care but is NOT a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the advice of a qualified veterinarian with any questions regarding your reptile's health.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
The reptile identification feature uses third-party AI technology and may not always be accurate. We do not guarantee the accuracy of species identifications. Always verify with expert sources and consult professionals when necessary.
To the maximum extent permitted by law, Khafi Studio LLC and its owner, affiliates, and agents shall not be liable for any:
Our total liability shall not exceed the amount you paid for the App or subscription in the past 12 months.
You agree to indemnify, defend, and hold harmless Khafi Studio LLC and its owner and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
The free version of the App displays advertisements provided by Google AdMob. We do not control the content of these advertisements. You can remove ads by purchasing the Pro Pack or subscribing to Premium.

We may update these Terms from time to time. Changes will be effective when posted with an updated "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms. For significant changes, we will provide notice through the App where appropriate.
You may stop using the App at any time by deleting it from your device. If you have an active subscription, it will continue until the end of the billing period unless cancelled.
We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in conduct we deem harmful to the App or other users.
Upon termination, your right to use the App will immediately cease. All data stored locally on your device will remain unless you delete it. No refunds will be provided for unused subscription periods, except where required by law.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Khafi Studio LLC is registered, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App should first be addressed by contacting our support team. We will attempt to resolve disputes informally and in good faith.
If informal resolution fails, disputes may be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court, except where prohibited by law.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Khafi Studio LLC regarding the App and supersede all prior agreements and understandings.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.
